Terms of Service

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Cypher ("we," "us," or "our"), concerning your access to and use of the cypherpuzzle.com website.

By accessing the Services, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms, then you are expressly prohibited from using the Services and you must discontinue use immediately.

1. Intellectual Property Rights

Unless otherwise indicated, the Services are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content") and the trademarks and logos contained therein are owned or controlled by us.

You are granted a limited, non-exclusive license to access and use the Services to play the game for your personal, non-commercial use. We reserve all rights not expressly granted to you.

2. User Registration

You may be required to register with the Services via a third-party provider (Google OAuth) to save your progress and statistics. You agree to keep your account credentials confidential and will be responsible for all use of your account. You may delete your account at any time from your profile settings, which permanently erases your account and gameplay data as described in our Privacy Policy. We reserve the right to remove, reclaim, or terminate accounts that violate these Terms or attempt to abuse the Services.

3. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. You agree not to:

  • Interfere with, disrupt, or create an undue burden on the Services or the networks connected to the Services.
  • Attempt to bypass any measures of the Services designed to prevent or restrict access to the server.
  • Systematically retrieve data to create or compile a database or directory without written permission.
  • Use automated scripts, bots, or data mining tools to interact with the game or extract puzzle solutions.

4. Disclaimer & Limitation of Liability

The Services are provided free of charge, on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure.

In no event will we be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, or punitive damages, including lost data, lost progress, or other damages arising from your use of the Services, even if we have been advised of the possibility of such damages.

Because the Services are provided free of charge, our maximum aggregate liability to you for any cause whatsoever will not exceed the total amount you have paid to use the Services, which is zero euros (€0).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Certain EU consumer protection laws do not allow limitations on implied warranties or the exclusion of certain damages; where these laws apply to you, some of the above disclaimers may not apply, and your statutory rights are unaffected.

5. Governing Law & Dispute Resolution

These Terms shall be governed by and defined following the laws of Portugal, and the courts of Portugal shall have jurisdiction to resolve any dispute which may arise in connection with these Terms. As an EU consumer, you also possess the statutory right to bring proceedings to the courts of your local country of residence, and to use the European Commission's Online Dispute Resolution platform.

6. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion. We will post any material changes to these Terms and update the "Last updated" date above; significant changes take effect a reasonable period after they are posted. We cannot guarantee the Services will be available at all times. We may experience hardware or software problems or need to perform maintenance, resulting in interruptions, delays, or errors.
